Website use

You may browse our website for lawful purposes only. You must not attempt to interfere with the site's operation, introduce malicious code, scrape content at scale, or use the site in any way that could harm Devoq or other users. Content on this website — including text, graphics and code samples — is owned by Devoq or our licensors and is protected by Australian copyright law. You may not reproduce it without our written permission.

Services and proposals

Information on this website is general in nature and does not constitute a binding offer. Project scope, deliverables, timelines and fees are defined in a written proposal or statement of work ("SOW") agreed by both parties before work begins. In the event of conflict between these Terms and a signed SOW, the SOW prevails for that project.

Client responsibilities

When you engage our services, you agree to:

  • Provide accurate information and timely feedback
  • Supply content, assets and approvals within agreed timeframes
  • Ensure you have rights to any materials you provide to us
  • Pay invoices according to the agreed schedule

Delays caused by late client feedback or missing assets may affect project timelines. We will communicate impact promptly and propose revised schedules where needed.

Fees and payment

Fees are quoted in Australian dollars (AUD) unless stated otherwise. Unless your SOW says differently, we may invoice a deposit before work commences, with progress or milestone payments for larger projects. Invoices are due within fourteen (14) days unless otherwise agreed. Late payments may pause work until accounts are settled. All prices are exclusive of GST unless stated as GST-inclusive.

Intellectual property

Upon full payment of all fees due for a project, you receive ownership of the final deliverables created specifically for you — typically website designs, front-end code and project documentation as defined in your SOW. Devoq retains ownership of pre-existing tools, frameworks, libraries and general know-how used across projects. We may display completed work in our portfolio unless you request otherwise in writing before launch.

Warranties and limitations

We provide services with reasonable skill and care consistent with industry standards for Australian digital agencies. Except as required by the Australian Consumer Law, we make no warranties that a website or campaign will achieve specific rankings, traffic levels or revenue outcomes — those depend on market conditions, competition and ongoing effort.

To the maximum extent permitted by law, our liability for any claim arising from our services is limited to the fees paid by you for the specific project giving rise to the claim. We are not liable for indirect or consequential loss, including lost profit or business interruption, except where such limitation is prohibited by law.

Termination

Either party may terminate a project in accordance with the termination clause in the relevant SOW. If no SOW exists, either party may terminate on fourteen (14) days' written notice. You remain responsible for fees for work completed up to the termination date.

Governing law

These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales. If any provision is found unenforceable, the remaining provisions continue in full force.

Changes

We may update these Terms from time to time. The current version will always be available on this page. Material changes will be noted by updating the date above.
